List of state laws recognizing online notary and out-of-state notary acts​​

Alabama

Even though Alabama does not currently authorize its own notaries to perform online notary, Alabama law recognizes and accepts online notarizations performed by out-of-state notaries under their state rules (Alabama Code Section 35-4-2635-4-27,  and 12-21-4.)

Alaska

Online notary is legal in Alaska under Alaska Stat. § 44.50.075.

Alaska law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See Alaska Stat. § 09.63.050.)

Arizona

Arizona notaries can perform online notarizations under Ariz. Rev. Stat. Ann. § 41-263. Arizona also recognizes the legal effect of online notarizations that are performed by notaries of other states under Ariz. Rev. Stat. § 41-259.

Arkansas

Arkansas approved online notary legal under the Arkansas Code § 21-14-301.

Arkansas law also recognizes online notarizations performed by notaries from other states under the Arkansas Code § 16-45-102§ 16-47-103§ 16-47-210, and § 18-12-203.

California

California signers looking to have their documents notarized remotely can access these services in any other state that currently offers remote online notarization. Under the California Civil Code 1189(b), a notarial certificate from another state is valid as long as it complies with the laws of that state. Currently, California does not allow its own notaries to perform remote online notarization. However, thanks to the passing of California Senate Bill 696 in 2023, remote online notary (RON) will be implemented in California by January 1, 2030 or sooner.

Colorado

Online notary is legal in Colorado pursuant to amendments to Title 24, Article 21, Part 5 of the Colorado Revised Statutes.

Colorado law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (see Sections 24-21-511, 38-30-126, and 38-35-105 of the Colorado Revised Statutes).

Connecticut

Online notary is legal in Connecticut. On June 12, 2023, the Governor signed Public Act 23-28 (An Act Concerning Remote Notarial Acts). 

Connecticut law recognizes and accepts online notarizations performed by out-of-state notaries under its current state rules (Connecticut General Statutes §§ 1-301-5747-5a, and 52-148c.)

Delaware

Once effective and implemented, Title 29 of the Delaware Code § 4320 authorizes remote online notary for Delaware notaries.

​​Delaware law recognizes and accepts online notarizations performed by out-of-state notaries under its current state rules (Title 29 of the Delaware Code § 4324.)

District of Columbia

Although Washington, D.C. has not yet implemented rules allowing its notaries to perform online notarizations, it recognizes online notarizations performed by notaries of other states under D.C. Code §§ 1-1231.10.

Florida

Online notary is legal in Florida under Chapter 117, Part II of the Florida Statutes.

Florida law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (see Sections 92.50695.03, and 90.902 of the Florida Statutes).

Georgia

Even though Georgia does not currently authorize its own notaries to perform online notary, Georgia law recognizes and accepts online notarizations performed by out-of-state notaries under their state rules (Georgia Code Title 44 § 44-2-21§ 44-2-21,  § 44-14-34§ 44-14-62, and Title 9. § 9-10-113.)

Hawaii

Online notary is legal in Hawaii under HI Rev Stat § 456-23.

Hawaii law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See HI Rev Stat §§ 502-45502-46, and 621-13.)

Idaho

Online notary is legal in Idaho under IDAPA 34.07.01.

Idaho law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See Idaho Code § 51-11155-805, and 9-1401.)

Illinois

llinois recently approved online notary legal under (5 ILCS 312/) Illinois Notary Public Act, effective upon passage of rules.  Illinois law also recognizes online notarizations performed by notaries from other states under Illinois Statutes Chapter 5 Section 255/6 and Illinois Statutes Chapter 765 Section 30/2 and 5/20.

Indiana

Online notary is legal in Indiana under Ind. Code § 33-42-17-3.

Indiana law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See Ind. Code § 33-42-9-8.)

Iowa

Online notary is legal in Iowa under Iowa Code 9B.

Iowa law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See Iowa Code 9B.11558.20622.86.)

Kansas

Online notary is legal in Kansas under Kansas Statutes § 53-5a15.

Kansas law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See Kansas Statutes § 53-5a11 and § 58-2228.)

Kentucky

Online notary is legal in Kentucky under KRS 423.455.

Kentucky law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See KRS 423.110.)

Louisiana

Online notary is legal in Louisiana under Title 35 Chapter 10 of the Louisiana Statutes.

Louisiana law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See LA Rev Stat § 35:5§ 35:6, and § 35:513.)

Maine

Online notary is legal in Maine under Title 4 §1915 of the Maine Revised Statutes.

Maine law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See Title 4 § 1911 of the Maine Revised Statutes.)

Maryland

Online notary is legal in Maryland under Maryland Code, Article-State Gov’t § 18-201.

Maryland law also recognizes and accepts online notarizations performed by out-of-state notaries under their state rules. (See Maryland State Government Section 19-103.)

Massachusetts

Massachusetts approved online notary legal under Mass. General Laws c.222 § 28. Massachusetts law also recognizes online notarizations performed by notaries from other states under Mass. Gen. Laws ch. 183 § 30 and § 41 and ch. 233 § 73.

Michigan

Michigan approved online notary legal under Sections 55.285 to 287 of the Michigan Compiled Laws.  Michigan law also recognizes online notarizations performed by notaries from other states under the Michigan Compiled Laws Sections 55.285a565.9565.10565.352, and 565.601.

Minnesota

Minnesota approved online notary legal under Minnesota Statutes Sec. 358.645.  Minnesota law also recognizes online notarizations performed by notaries from other states under Minnesota Statutes Sec. 358.61.

Mississippi

Even though Mississippi does not currently authorize its own notaries to perform online notary, Mississippi law recognizes and accepts online notarizations performed by out-of-state notaries under their state rules (Miss. Code § 25-34-23.)

Missouri

Online notary is legal in Missouri pursuant to Chapter 486.1100-1205 of the Missouri Revised Statutes,

Missouri law also recognizes and accepts online notarizations performed by out-of-state notaries under Chapter 486.775 of the Missouri Revised Statutes.
